What stipulations are included in assault bail bonds?

There are also several stipulations and/or conditions that are associated with assault bail bonds in order to protect the victim from any type of harassment from the defendant. A crucial part of an assault bail bond is the Personal Protection order. Basically, it contains a set of parameters that all defendants must obey. If there is any violation of any one of these parameters, the bail of the defendant will most likely be cancelled and the defendant will be arrested again and returned to jail due to non-compliance.

The personal protection order says that depending on the intensity of the assault the defendant is accused of, the defendant will be required to always maintain a distance from the victim ranging from 100 yards to whatever distance a judge deems necessary for the victims safety all the time.

The no-contact order prohibits any kind of contact done by the defendant to the victim. The defendant can’t contact the victim or have anyone else contact the victim on the defendant’s behalf in any way under any circumstances, such as over the phone, text messages, driving by their place of residence or any other place they are known to frequent, or email.

There are several different types of assault that are typically recognized in most jurisdictions. These include:

Felony assault and battery: an unlawful attack or attempted attack through force or violence, that causes physical injury to another person. This type of assault involves the use of weapons and/or serious injury. If a weapon is used, an attack is deemed a felonious assault even if no injury occurs. But there need not be a weapon for this designation. If a serious injury occurs due to an assault using hands, fists, or feet, it is also deemed a felonious assault. Both serious resulting injuries and the use of weapons are triggers for a felonious assault.

Simple assault: when a weapon is not used and the resulting injuries that are caused to the victim are minor.

Physical assault causes bodily harm.

Aggravated assault: done with the use of a weapon and/or an amount of increased force.

Sexual assault: the use of force against the will of the victim, resulting in a rape, molestation, sodomy or similar sexual offense.

Verbal assault: non-physical, oral assault that results in an emotional, mental, and/or psychological injury to the victim.

Cost For An Assault Bail Bonds

If you are facing assault charges the bail amount will depend on the level and type of assault. Assault with a dangerous weapon will likely require a higher bail amount. These can start at $10,000 and will be set according to whatever amount the judge deems necessary to secure the defendants return for all court appearances and any other requests or requirements that may be set as a condition of the bail bonds. Please keep in mind that these numbers aren’t exact and bail bonds agents have no control, say so or input on bond amounts. We can ONLY assist in getting the bonds posted once the judge or magistrate determines whether or not bail will be set, and if so, they will determine the amount of the bail.

Preconditions Assault Bonds

Preconditions are used in assault bail bonds primarily for the protection of the victim, but also to serve as official notice to the defendant that they will be held accountable for any and all actions that go against what the judge or magistrate has set as conditions for their bond to stay in place. The personal protection order has guidelines that the defendant must follow precisely. Any violation of these guidelines generally results in the defendant’s bond being held insufficient and a new warrant being issued which will ultimately result in the defendant being placed back into custody. Often times when this happens, the judge or magistrate may determine the original bond was not sufficient to deter the defendant from violating the order. If that is the case, the judge or magistrate will determine if a higher bond is required or if the defendant should not receive a bond at all. No receiving a bond, or getting “No Bond” means the defendant will remain in custody until either the judge sets a new bond or there is a disposition on the case.
